First Car WA is committed to providing quality services to our clients and this policy outlines our ongoing obligations to our clients in respect of how we manage personal information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

This Privacy Policy (“Privacy Policy”) describes the policies and procedures of First Car WA (“we”, “our” or “us”) on the collection, use and disclosure of your information on https://1stcarwa.com.au/ (the “Site”) and the services, features, content or applications we offer (collectively with the Website, the “Services”, and together with the Website, the “Site”).

By using or accessing this Site, you are accepting the terms and conditions of this Privacy Policy and agreeing that we will have the right to use your personal and other information as described in this Privacy Policy in line with the Australian Privacy Principles.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include names, addresses, email addresses, phone, and facsimile numbers.

This Personal Information is obtained in many ways including [interviews, correspondence, by telephone and facsimile, by email, via our website https://www.1stcarwa.com.au/, from your website, from media and publications, from other publicly available sources, from cookies and from third parties. First Car WA do not guarantee website links or policy of authorised third parties (refer to First Car WA Terms of Use).

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:

• For the primary purpose for which it was obtained.
• For a secondary purpose that is directly related to the primary purpose.
• With your consent; or where required or authorised by law.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Your Personal Information may be disclosed in a number of circumstances including the following:

Security of Personal Information

However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

First Car WA will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.

To protect your Personal Information, we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete, and up to date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Account with the Site

To use certain products or services provided by us from time to time, you are required to create an account and will be asked to provide certain Personal Identifiable Information. 

Financial Transactions

We may use third parties to provide credit card and other payment processing services through the Site. When you make or receive any payment on or through the Site, you will be required to provide us and/or our authorised third-party agents with financial information and related payment information.  We and our third-party agents may retain the details of financial transactions or payments you make on or through the Site.

Non-Personally Identifiable Information

During your visit to the Site, we may collect anonymous Non-Personally Identifiable Information such as the activity of your browser when you are viewing the Site; your site path during your visit to the Site; demographic data; the amount of time you spend on the Site and general information regarding your Internet service provider and host. Logging of Your Activities on the Site

Information Collected by Third Parties

We may use your email address, phone number, mailing address, or other contact information to send you communications, such as notifications, information about new services, special offers, promotions, newsletters, etc. If you do not wish to receive communications, you may be able to unsubscribe from certain communications by clicking “unsubscribe” in an email depending on the type of email being sent. 

Additionally, we may disclose the user information (“User Information”) we collect on the Site, under the following circumstances:

If we sell all or a part of its business or makes a sale of all or a material part of our assets or are otherwise involved in a merger or transfer of all or a material part of our business, then as part of the applicable transaction, we may transfer your User Information to the party or parties involved in the transaction. We may also share and/or transfer your User Information to any or all its affiliated entities (such as any subsidiary or parent). In this circumstance you will be given ample notification of this change and given the opportunity to delete your account and request your information to be removed.
3. We may disclose any or all User Information to protect or defend the legal rights or our property or its employees, agents and contractors; to protect the safety of the general public, the users of the Site and/or our employees, agents and contractors; and to investigate, prevent or take action regarding suspected or actual illegal activities or fraud.

Content Posted to Public Areas of the Site

If you post or provide any information in any public area on the Site or if you otherwise make any information about yourself publicly available on the Site, you should be aware that any publicly disclosed Personal Identifiable Information  can be read, collected, or used by other users of the Site, and could be used to send you unsolicited messages or otherwise. We are not in any way responsible for the non-disclosure or protection of any Personal Identifiable Information or other information you choose to publicly disclose on or through the Site. You are solely responsible for all the consequences resulting from any such public disclosure.

Third Party Websites

The Site may contain links to third party websites. By accessing and/or using a linked third-party website, you may be disclosing your personal information to such linked website. Therefore, you should carefully review the privacy policies of these other websites. If you are not comfortable with the policies of a linked website, you should not access and/or use that website. We are not responsible for the policies (privacy or otherwise) or the content, services or products offered by or through any third-party website. It is solely your responsibility to review the privacy policy and other policies of third-party websites to confirm that you understand and agree with their policies.

Data Security

We use commercially reasonable efforts to comply with industry standards with respect to encryption technologies with respect to the receipt and transfer of User Information you submit to us via the Site, including using SSL technology for certain sensitive information. Nevertheless, no transmission over the Internet and no data storage method can be guaranteed to be safe 100% of the time. We do not guarantee that its security measures will not be circumvented or breached or that your User Information will not be accessed by, used by, modified by, or disclosed to a third party. We are not responsible for any such circumvention or breach by any third party. Additionally, it is solely your responsibility, and not our responsibility, to protect the confidentiality of your password and login credentials.

Updating Your Information and Deleting Your Account

Once your account is setup, you can at any time access your account to add, delete or modify any information which you have provided. Should you ever decide to delete your account, you may do so by sending an email to Steve or Scott at firstcar@live.com. Please note that even after you terminate your account or delete or modify information from your profile, copies of the original information may remain viewable on the Site and/or elsewhere to the extent that your information was publicly posted by you or with your authorisation, previously shared with others, or otherwise distributed pursuant to your privacy settings. Additionally, even if you have requested that your User Information be deleted, we may retain a record of such information (including Personal Identifiable Information).
